Katherine, 80, backed the Heal The World Foundation in its legal fight with the executors who want to stop the charity using his image.
She said in a court declaration Jacko would be upset "to know our charity was being torn down" and his "desires distorted" due to "greed".
Katherine, husband JOE, 81, and Jacko's brother RANDY, 49, joined the charity last year. The family has been at war with the executors since his 2009 death aged 50.
In the papers filed in LA, she said: "Funds are being used to hire lawyers that suppress my family's ability to support charity, instead of giving away 20 per cent according to my son's wishes."
The executors' lawyers said: "Michael did not give away rights to use his image."
The case is set for April 29.
