Her lawyer had hoped to secure a deal to keep her out of prison after the 24-year-old actress was charged with stealing from a jewellery shop in Venice, California.
But Los Angeles Judge Keith Schwartz told the Mean Girls star: "I don't care if you're Lindsay Lohan.
"This case does involve jail time period. If you plead in front of me and this case is resolved in front of me you are going to jail. Period."
The actress has until her next court hearing on March 10 to decide whether or not to accept a plea.
Lohan, who is currently free on a £20,000 bail, was sent to prison twice last year for violating the terms of her 2007 DUI conviction.
She has only recently left a rehab facility, where she's again been battling her drink and drug demons.
